Spanish Probate fees
Our professional fees are charged at an hourly rate of £250 plus VAT. Once you have explained the circumstances of the matter to us, we will be able to provide you with an estimate of our fees to complete the matter, together with an estimate of the disbursements payable to third parties.
Our fees and disbursements will depend on the individual circumstances of the matter. Our fee for a standard Spanish probate matter can vary between £2,950 and £3,750 plus VAT. This fee assumes (but is not limited to), the following :-
- The deceased was English/Welsh
- There is a valid Spanish Will
- There is no more than one property (with a value of 250,000 € or less) and that property has been registered correctly with the Spanish land registry
- There is no more than one bank account
- There are no Spanish shares
- There are no more than 2 beneficiaries,
- We are instructed by all beneficiaries
- There is no dispute between the beneficiaries on the division of assets
- The beneficiaries are easily contactable, cooperative and are individuals (as opposed to a Company/Charity),
- There are no claims made against the estate
What services are included
- Reviewing the terms of the Will (and cross referring any English Will/Probate)
- Obtaining a Certificate of Last Will and Testament and insurance from the Spanish Central Wills Registry;
- Where necessary arranging the legalisation and translation of English documents to be accepted in Spain
- Drafting Spanish Power of Attorney for each beneficiary, if necessary
- Liaising with all relevant Spanish authorities/experts to calculate value of the Spanish estate
- Calculating any Spanish taxes, local taxes and registration fees that may be due
- Arranging the Notary appointment to execute the inheritance deed
- Arranging the registration of the inheritance deeds with the relevant Land Registry
Disbursements
Disbursements are costs related to your matter that are payable to third parties, such as Spanish Notary fees. The disbursements which we anticipate will apply, are set out separately below. This list is not exhaustive and other disbursements may apply depending on the particular matter. We will update you on the specific fees, once we have more information.
Exclusions
- Spanish Land Registry Search (30 €)
- Spanish Land Registry fee (300-600 €)
- Experts and Associate fees (800-1000 €)
- NIE application (120 € per beneficiary )
- Spanish Notary (this depends on the value of the estate and the number of pages of the inheritance deed but could be between 800 – 1,100 €)
- English Notary fee (per Power of Attorney document) ( £120-£180 plus VAT )
- Fee per Apostille fee + PP (approximately £36 )
- Spanish Inheritance Tax (dependent on the value and location of the Spanish estate and the type and number of beneficiaries)
- Plusvalía tax (municipal tax) calculated by the Town Hall
- Official Legal Translations (£300.00 )
- Searches, postage & admin fee to file tax forms with office in Madrid (250 € )
Dealing with the sale or transfer of any property in the estate is not included.
How long will this take?
On average, estates that fall within this range are dealt with within 10-18 months. Typically obtaining and preparing all the documentation required in Spain can take about 3 months. Once matters transfer to Spain it can take considerably longer, as we are then dependent on the action and speed of third parties.
